§ 16-251. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this Section, except where the context clearly indicates a different meaning:

    City shall mean the City of Effingham, Illinois,

    Illinois Vehicle Code shall mean the Illinois Vehicle Code (625 ILCS 5/101 et seq.) as supplemented and amended.

    Motor vehicle shall mean any vehicle which is self-propelled and designed to travel along the ground and shall include, but not be limited to, automobiles, buses, motor bikes, motorcycles, motor scooters, trucks, go carts, golf carts, campers and trailers.

    Officer shall mean a police officer with the Police Department of the City of Effingham, Illinois,

    Owner of record shall mean a person who holds legal title of a vehicle, a person who has registered a motor vehicle in his/her name with the state, or in the event a motor vehicle is subject to an agreement for a conditional sale, lease, or mortgage which vests an immediate right of possession in a conditional vendee, lessee, or mortgagor, then such conditional vendee, lessee, or mortgagor shall be deemed the owner of record.

    Person shall mean any individual, firm, partnership, organization, corporation, limited liability company, club, association, proprietorship, political subdivision, or other legal entity. It shall also include an executor, administrator, trustee, receiver or other representative appointed according to law. Whenever the word "Person" appears in any section of this title prescribing a penalty or fine, as to partnerships or associations, the word shall include the partners or members thereof, and as to corporations or limited liability company, shall include the officers, agents or members thereof who are responsible for any violation of this article.

    Police chief shall mean the Chief of Police of the City of Effingham, Illinois, or his/her authorized designee.

    Police department shall mean the City of Effingham, Illinois, Police Department.
