§ 2-370. Management rights.

  • The Employer has the statutory right and authority to administer the business of the City and, in addition to other functions and responsibilities which are required by law, the Employer has the full right and responsibility to direct the operation of City departments, to promulgate rules and regulations, and to otherwise exercise the prerogatives of management, which more particularly include but are not limited to the following:

    A.

    To manage and direct City employees, including the right to hire, classify, promote, demote, assign, train, retrain, place on probation, evaluate, layoff, recall, enforce corrective actions, suspend, remove, and maintain order among employees;

    B.

    To manage and determine the location, type and number of physical facilities, equipment, programs, and the work to be performed;

    C.

    To determine each department's mission, goals, objectives, programs, and services and to utilize personnel in a manner designed to effectively meet these purposes;

    D.

    To determine the size and composition of the work force and the organizational structure;

    E.

    To determine the hours of work and work schedules for individual employees;

    F.

    To determine the necessity to schedule overtime and the amount required;

    G.

    To determine when a position vacancy exists, the duties to be performed by job classifications, and the standards of quality and performance to be maintained;

    H.

    To maintain the security of records and other important information;

    I.

    To determine and implement necessary actions in emergency situations;

    J.

    To establish and modify benefits and wages;

    K.

    To set and amend budgets and to determine the utilization of technology, including the introduction of new or improved methods or facilities, or the changing of existing methods or facilities.
