§ 2-388. Seniority.

  • Seniority shall be considered on a departmental basis and computed from the day, month, and year of an employee's last hiring. Seniority shall be a factor only in matters with regard to accrual of benefits, lay-off, re-employment, promotions, and demotions due to a reduction of the work force.

    a.

    Retention of seniority upon promotion: Employees who are promoted to a supervisory position will retain all seniority accumulated prior to the date of promotion.

    b.

    Retention of seniority when recalled from layoff: Employees who are recalled from a layoff within one year of the layoff will retain all seniority accumulated prior to the date of the layoff.

    c.

    Discontinuation of seniority: Accumulation of seniority shall be discontinued under any of the following conditions:

    1.

    If the employee quits, resigns, retires, or is terminated for any reason.

    2.

    If the employee fails to return to work upon expiration of an excused leave of absence, or the employee accepts employment during a leave of absence, except as approved by the city.

    3.

    If the employee is laid off for a period of one year or more.

    4.

    If, when an employee is laid off for less than a year, the employee does not accept re-employment when offered.
