§ 4-25. Renewal.

  • (a)

    Any licensee or holder of a public property café permit may renew his license or permit, as the case may be, at the expiration thereof; provided, that he is then qualified to receive a license or public property café permit, and the premises for which such renewal license or public property café permit is sought are suitable for the purpose; provided, further, that the renewal privilege herein contained shall not be construed as a vested right which shall in any case prevent the city council from decreasing the number of licenses to be issued within the city. Except for the original application fee, the requirements for and the procedures for obtaining a renewal of a license or public property café permit shall be the same as that provided for in case of an original application for a license or public property café permit, however, that any application for renewal shall be filed with the local liquor control commissioner not less than thirty (30) days prior to the expiration of the license or public property café permit. Notwithstanding the foregoing, any licensee holding an EEV license, shall submit, along with an application for renewal, a detailed summary of the events held at the licensed premises for the preceding calendar year.

    (b)

    The failure to renew a license or public property café permit as prescribed or to pay the required annual license or public property café permit fee before the expiration date shown on the license being renewed shall result in the lapse of the license or public property café permit. No licensee or holder of a public property café permit may sell alcoholic liquor after the expiration of his or her license or public property café permit until the license or public property café permit has been reissued after payment of the application fee for an original application/new license or public property café permit, as provided for in subsection (c)(1) of section 4-23 of article III of this ordinance, as well as the applicable annual fee, as provided for in section 4-23(e) of article III of this ordinance.
