§ 10-11. Reimbursement policy for emergency response costs by individuals convicted of arson.

  • (a)

    Effective January 1, 2012, any individual convicted of arson, aggravated arson, or place of worship arson for setting a fire within the corporate limits of the City of Effingham shall reimburse the city for any and all emergency response costs incurred in responding to a fire that said individual is convicted of setting, as follows:

    (1)

    The reasonable costs of each vehicle responding as determined by the responding emergency response department, but in no case less than five hundred dollars ($500.00) per hour per vehicle; and

    (2)

    The cost of all personnel, including any overtime costs to the City of Effingham or to any responding emergency response department incurred as a result of the emergency response services; and

    (3)

    The cost of all materials and equipment used, expended, depleted, destroyed or removed from service as a result of the emergency response services.

    (b)

    Notwithstanding the foregoing, the actual costs to be reimbursed by any individual convicted of arson, aggravated arson, or place of worship arson for setting a fire within the corporate limits of the City of Effingham shall be deemed to be not less than one thousand dollars ($1,000.00) nor more than ten thousand dollars ($10,000.00) per each city emergency response department.
