§ 22-92. Abandonment of underground facilities, reports and maps.

  • The city engineer shall require submission of information on and shall keep records of abandoned utilities within the right-of-way

    (a)

    Filing of facility abandonment records. Whenever any facility is abandoned in the public right-of-way, the owner or person using, controlling or having an interest therein, shall, within thirty (30) calendar days after such abandonment, file in the office of the city engineer a map with a statement in writing, giving in detail the location of the facility so abandoned. Each map, set of maps, or plans filed pursuant to the provisions of this article, including those maps or plans required by subsection 22-83(k) shall show in detail the location of each such facility abandoned subsequent to the filing of the last preceding map, set of maps, or plans.

    (b)

    Failure to file. An owner or person who fails, refuses, or neglects to file any map or set of maps at the time, and in all respects as required by this section 22-92 shall be subject to the penalties pursuant to subsection 22-83(l).
