§ 22-311. Penalties.

  • (a)

    Any person found to be violating any provision of this ordinance, except section 22-287, shall be served by the city with written notice stating the nature of the violation and providing ten (10) days for the satisfactory correction thereof. The offender shall, within said ten-day period of time permanently cease and correct all violations. The city may revoke any permit for sewage disposal as a result of any violation of any provision of division 2 of this ordinance.

    (b)

    Any person who shall continue any violation beyond the time limit provided for in subsection 22-311(a), shall be guilty of a civil ordinance violation, and on conviction thereof may be fined in the amount not exceeding one thousand dollars ($1,000.00) for each offense. Each day in which any such violation shall continue shall be deemed a separate offense. The city may also seek injunctive and/or declaratory relief.

    (c)

    Any person found to be violating any provisions of section 22-301 of this ordinance shall be guilty of a civil ordinance violation and shall be subject to a fine of not more than five hundred dollars ($500.00) for each offense. Each day in which any such violation shall continue shall be deemed a separate offense. The city may also seek injunctive and/or declaratory relief.
