§ 16-139. Enforcement and penalties for violation.

  • (a)

    Notice of violation. A police officer, and/or the corporate authorities of the city or such other person or agencies so designated by the corporate authorities of the city, shall attach to any vehicle parked in violation of any of the provisions of sections 16-127 through 16-133, 16-137 or 16-138 of this article, or hand to the operator of the vehicle if he or she is present, a notice that such vehicle has been illegally parked.

    (b)

    Notwithstanding any provision of this article, any person accused of violating any of the provisions of sections 16-127 through 16-133, 16-137 or 16-138 of this article, may pay, as full satisfaction of such violation, to the city a fee of five dollars ($5.00) within thirty (30) days of the time when such notice was attached to the vehicle or pay to the city a fee of ten dollars ($10.00) subsequent to said thirty-day period and prior to a forty-five-day period.

    (c)

    Any person accused of violating any of the provisions of sections 16-127 through 16-133, 16-137 or 16-138 of this article, who fails to make payment for said violation within forty-five (45) days of the violation shall be fined not less than one hundred dollars ($100.00) nor more than two hundred dollars ($200.00) for each such offense.

    (d)

    Vehicle ownership as prima facie evidence of violation. The fact that a vehicle which is found in violation of the provisions of sections 16-127 through 16-133, 16-137 or 16-138 of this article, is registered in the name of a person shall be considered prima facie evidence that such person was in control of the vehicle at the time of the violation.

    (e)

    Responsibility for violation. The registered owner of a vehicle found in violation of this article as well as the person in actual possession of the vehicle shall be responsible for any violation. The lessor of a vehicle is responsibility for providing information regarding the lessee of a vehicle within the time periods set forth in the Illinois Vehicle Code in order to avoid liability for unpaid fines.

    (f)

    Separate offense. A separate offense shall be deemed committed each hour during which a violation of sections 16-127 through 16-133, 16-137 or 16-138 occurs or continues.
